Terms of Service

These Terms govern your use of Daily Leveling ("we," "our," "us"), including our mobile application, website, and API (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EEA/UK) to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Your account

• You are responsible for maintaining the confidentiality of your password and API keys.
• You are responsible for all activity under your account, including activity from agents using your API keys.
• Notify us immediately of any unauthorized use at security@dailyleveling.app.
• One account per person. Multiple accounts to evade limits or bans is prohibited.

3. Acceptable use

See our full Acceptable Use Policy. In short: don't use the Service to break the law, harm others, abuse our infrastructure, or generate or store content that is illegal, harassing, or sexually explicit.

4. Your content

You retain ownership of the content you submit (tasks, goals, photos, descriptions — "Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process Your Content as needed to deliver the Service to you.

AI avatars: avatars generated from your photo via OpenAI's API are derivative works. You may use the generated avatar within the Service. We don't claim ownership over your likeness or photo.

5. Our content & intellectual property

The Service, including its branding, logos, design, code, and original content, is owned by Daily Leveling and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

6. API & agent usage

If you mint an API key, you may grant access to AI agents (ChatGPT, Claude, Cursor, etc.). You are responsible for the actions those agents take on your behalf. We may rate-limit, suspend, or revoke API keys that exhibit abusive patterns.

The API is for managing your own account only. Reselling access, scraping, or building competitor services off our API is prohibited.

7. Pricing & payment

The core Service is currently free. If we introduce paid features, we'll give clear notice and pricing in advance. Existing free features won't be retroactively gated without notice.

8. Termination

You may delete your account at any time via the app (Profile → Account → Delete Account) or at /delete-account. We may suspend or terminate your account if you violate these Terms or our Acceptable Use Policy. Upon termination, your right to use the Service ends; data deletion follows our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI-GENERATED CONTENT (AVATARS) WILL MEET YOUR EXPECTATIONS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DAILY LEVELING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) USD $100, OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You agree to indemnify and hold Daily Leveling harmless from claims, losses, and liabilities arising out of your violation of these Terms, your misuse of the Service, or content you submit.

12. Apple App Store terms

If you use the iOS app, you acknowledge:

• These Terms are between you and Daily Leveling, not Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for the Service.
• Apple is a third-party beneficiary of these Terms and may enforce them.
• If the Service fails to conform to any applicable warranty, Apple's only obligation is to refund the purchase price (the Service is currently free).
• You comply with the App Store Terms of Service and applicable export laws (you are not located in a US-embargoed country and not on a US prohibited-persons list).

13. Google Play terms

If you use the Android app, you also agree to comply with Google Play's Terms of Service. Google is not a party to these Terms.

14. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved through binding arbitration administered by JAMS in accordance with its rules, on an individual basis (no class actions). You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@dailyleveling.app.

15. Changes

We may update these Terms. Material changes get 14-day advance notice via email or in-app. Continued use after the effective date constitutes acceptance.
